Information on amendments to the Procedures on Extending the Term of Eurasian Patent
Procedures on Extending the Term of a Eurasian Patent (hereinafter – Procedures), approved by Order №8 of the Eurasian Patent Office (hereinafter- EAPO) on March 5, 2009, with amendments approved by Order №13 of the EAPO on April 8, 2010 and on March 30, 2011, Order №8, and on December 17, 2013, Order №50, were amended as follows:
1) in sixth paragraph of item 3.3 the word “name” replaced by “indication”
2) paragraphs five and six of item 4.13 are set forth in the following redaction:
“- indication of the claim(s), in respect of which the term of the Eurasian patent is extended, with indication of the product, for which received permission for application and in respect of which the extension of the patent term is being applied;
- indication of the state party to the Convention, in respect of which the term of the Eurasian patent is extended;”
The above stated amendments came into force on December 20, 2013.
Abovementioned changes also apply in respect of applications for the extension of the term of the Eurasian patent filed before December 20, 2013, which to this date are being processed at the Eurasian Office or, in case the processing is terminated, and the period for restoration of rights under Rule 39 (2) of the Regulations has not elapsed.
